Terms of Service

For purposes of these Terms:

"Platform"

means the Pediatric Dental Content Library website, its services, software, database, and content-sharing functionality.

"User"

means any pediatric dental office, dental practice, authorized employee, contractor, or representative who registers to access the Platform.

"Creator"

means any registered User who uploads images, videos, captions, graphics, text, or other media to the Platform.

"Content"

means all images, videos, written captions, descriptions, graphics, downloadable media, and other materials made available through the Platform.

"Licensed Content"

means Content uploaded by a Creator and made available for use by other eligible Users under these Terms.

"Office"

means the registered pediatric dental practice associated with a User account.

"Approved Social Channels"

means the registered Office's official Instagram and TikTok accounts only.

Access to the Platform is strictly limited to licensed pediatric dental offices and their authorized personnel.

By registering, you represent and warrant that:

• You are affiliated with a legitimate pediatric dental practice;
• You are authorized to act on behalf of that practice;
• All registration information provided is accurate;
• You will use the Platform only in accordance with these Terms.

The Platform reserves the right to approve, reject, suspend, or terminate any account at its sole discretion.

The Platform exists as a collaborative content-sharing library where pediatric dental offices may:

• Download social media content contributed by other pediatric dental offices;
• Share original content with peer offices;
• Collaboratively reduce content creation costs;
• Support community marketing initiatives.

The Platform is not intended to serve as a commercial stock media marketplace.

To promote fair access:

• Each registered Office may download one (1) piece of Content per calendar day;
• Download activity may be monitored and logged;
• Limits apply per registered physical office location;
• Attempts to circumvent download limits through multiple registrations, alternate accounts, or misleading registration details are prohibited.

The Platform reserves the right to suspend access for abuse.

To ensure fair use and eligibility, Users acknowledge that the Platform may collect and track:

• Office address;
• Account registration information;
• Download history;
• Device/IP access logs;
• Platform usage behavior.

This information may be used solely for:

• enforcing platform rules;
• preventing abuse;
• validating pediatric dental office eligibility;
• maintaining platform integrity.

By uploading Content, each Creator grants all eligible Users a non-exclusive, royalty-free, license-free, revocable, limited license to use the uploaded Content solely as permitted under these Terms.

This license allows:

• downloading the Content;
• posting the Content to Approved Social Channels;
• minor edits such as resizing, cropping, caption adjustments, or formatting for social media posting.

This license does NOT allow:

• resale;
• sublicensing;
• redistribution outside the Platform;
• use in paid advertising campaigns unless expressly permitted;
• use on websites, print materials, email marketing, or third-party commercial campaigns.

Users may only use downloaded Content:

• for their own pediatric dental office;
• on their official Instagram account;
• on their official TikTok account;
• in compliance with all applicable laws and social media platform rules.

Content may not be used by:

• agencies;
• consultants for unrelated clients;
• non-pediatric dental businesses;
• third-party marketers.

Each Creator remains solely responsible for all Content they upload. By uploading Content, the Creator represents and warrants that:

• they own the Content OR possess all necessary rights and permissions;
• the Content does not infringe intellectual property rights;
• the Content does not violate copyright laws;
• the Content does not violate trademark rights;
• the Content does not violate privacy rights;
• the Content does not violate publicity rights;
• all identifiable individuals (if applicable) have granted appropriate permissions;
• any music, audio, logos, or third-party assets are properly licensed.

The Platform does not verify ownership.

Users who download Content are not responsible for independently verifying ownership or licensing rights.

Responsibility for legality, ownership, and permissions lies entirely with the original Creator.

Any dispute, claim, infringement allegation, or legal issue arising from uploaded Content shall remain solely between the complaining party and the Creator.

Creators agree to defend, indemnify, and hold harmless:

• the Platform;
• its owners;
• operators;
• administrators;
• participating Users;
• pediatric dental offices using the Content

from any claims arising from:

• copyright infringement;
• trademark disputes;
• privacy violations;
• publicity rights claims;
• licensing disputes;
• unauthorized content use originating from the Creator’s upload.

The Platform reserves the right to remove, suspend, restrict, or permanently delete any Content that:

• appears infringing;
• violates these Terms;
• receives legal complaints;
• is inappropriate;
• creates platform risk.

Removal may occur without notice.

Users may not:

• upload stolen content;
• impersonate another practice;
• upload content they do not control;
• use automated scraping tools;
• download for resale;
• redistribute content outside permitted use;
• use content for political messaging;
• use content for unlawful activity;
• create multiple accounts to evade restrictions.

Content is provided “AS IS.” The Platform makes no warranties regarding:

• ownership;
• accuracy;
• legality;
• merchantability;
• fitness for a particular purpose;
• uninterrupted access.

To the fullest extent permitted by law, the Platform shall not be liable for:

• copyright claims;
• infringement disputes;
• user misuse;
• business losses;
• account suspension;
• removed content;
• platform downtime.

Users assume all use risk.

The Platform may suspend or terminate access for:

• rule violations;
• abuse;
• suspicious activity;
• fraudulent registration;
• misuse of community content.

Termination may occur without notice.

The Platform integrates with the Instagram and Facebook Graph APIs operated by Meta Platforms, Inc. (“Meta”). By using the Instagram features of the Platform, you agree to comply with:

• Meta’s Platform Terms and Developer Policies;
• Instagram’s Terms of Use and Community Guidelines;
• All applicable Meta policies governing the use of Instagram content and publishing APIs.

The Platform uses the Instagram Graph API solely to publish content to your Instagram Business or Creator account at your explicit direction. We do not access your Instagram data for any purpose beyond what is necessary to fulfill scheduled posts.

Meta is not affiliated with, does not sponsor, and is not responsible for the Platform or its services. Meta may restrict, suspend, or revoke API access at any time, which may affect or disable Instagram features on the Platform. We are not liable for any interruption caused by Meta’s actions.

If you connect an Instagram account to the Platform, you represent and warrant that:

• You are the owner or an authorized administrator of the connected Instagram Business or Creator account;
• The connected account is a Business or Creator account (not a personal account) linked to a Facebook Page;
• You have the authority to grant the Platform permission to publish content to that account on your behalf;
• All content you schedule for publication complies with Instagram’s Terms of Use, Community Guidelines, and applicable law;
• You will not use the Platform’s publishing features to post spam, misleading content, or content that violates any platform rules;
• You are solely responsible for all posts published to your Instagram account through the Platform.

You may disconnect your Instagram account at any time via the “Disconnect Instagram” button in your account. Disconnecting revokes our ability to publish to your account and removes your Instagram credentials from our systems immediately.

The Platform obtains limited data from the Instagram Graph API (specifically your Instagram User ID and access token) solely to publish content on your behalf. We do not:

• sell, license, or transfer your Instagram data to any third party;
• use your Instagram data for advertising, profiling, or any purpose beyond publishing scheduled posts;
• store, cache, or retain Instagram content (photos, videos, captions) from your personal Instagram feed;
• share your Instagram credentials with any other user or entity;
• use Instagram data to build user profiles beyond what is required to operate the Platform.

Instagram access tokens are deleted from our systems immediately upon disconnection of your account. See our Privacy Policy for full details on data handling and deletion.

The Platform may update these Terms at any time. Continued use constitutes acceptance.

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

By using the Platform, Users confirm they have read, understood, and agreed to these Terms.
